Attached to memo should have been Ott's affidavit, but it is not present. Tavenner indicates that "objections which we desire to make would be passed upon before the document is offered in evidence and that the prosectuion would be free to pursue such course as it deemed advisable with regard to a counter-affidavit or interrogatories."
