TOMOMORI did not know that the execution was illegal, believed it official, as did Defendant, but were later informed differently by the judge advocate. That morning TOMOMORI told Defendant there was to be an execution, said ’’Won’t you go if you have time?” At the scene Defendant said to form a stright line and watch properly, got in line with the others and closed his eyes. He did speak of the importance of international law and said that acts of cruelty must be forbiden.

ITEZONO (Idesono) directed everything at the execution. TOMOMORI gave no orders. When YAMAMOTO said atemi would be employed TOMOMORI sternly said ’’That is absolutely forbidden. Don’t do it.” When he saw they were going to carry it out without listening to him, he stopped them by saying ” It's pitiful and cruel.” TOMOMORI was only an observer, said that since their superiors were unable to come he would give his opinion— that international law must be carried out, that no cruel acts could be committed, that the execution that day was of enemies decreed by military court. 

On 21 August FUKUSHIMA, SATO and others met to conceal the incident, and TOMOMORI appeared for a very short while, left stating he had business. Defendant was present. TOMOMORI argued that the facts must be revealed.
